ChasingBlueSky 0 #27 December 1, 2004 It may be legal in some state, but not in Illinois. This was one of the main issues for me when I went to get one, and once I found out about the State policy on it, I picked one up. Check this out: http://www.rrstar.com/apps/pbcs.dll/article?AID=/20040905/NEWS0109/409050311&category=NEWS0109 Quote -PASS to the stand The Illinois State Toll Highway Authority tracks the date, time and location of every I-PASS transaction, and it stores that data for two years in compliance with state law. Primarily, the information is kept so that customers can review their account activity online, said spokeswoman Joelle McGinnis. The authority released I-PASS records in three cases in 2000, none in 2001, four cases in 2002, seven cases in 2003 and six cases in 2004, McGinnis said. She said seven subpoenas came from federal grand juries, 10 from state criminal courts and three from civil disputes. The information is released only in response to a subpoena, she said. The authority doesn’t share it with other state agencies and doesn’t sell it for commercial purposes. She stressed that the state has no plans to use the data to nab drivers speeding on the tollway. In a brief interview with the Rockford Register Star during a visit last week, authority Executive Director Jack Hartman echoed that thought. “I’m never going to do that,” he said. “We prefer the traditional method of cops on the side of the road.” Roughly the same thing was said in 1999 as well: http://www.elpc.org/lists/iltollways/msg00105.html Another one as well http://www.star.niu.edu/city/articles/101702-ipass.asp This is interesting - in 2001 this was talked about: http://www.isoc.org/internet/issues/privacy/balough.shtml QuoteThe Illinois Tollway Authority is conducting a feasibility study to use GPS technology to replace I-PASS and motorists tossing coins into the toll baskets. Instead, motorists using the Illinois tollways would be billed for actual miles driven based on information in onboard computers logging the roadway use through GPS. If the system becomes a reality, what data will the state tollway authority have and how will it use it? I can also say that I have been in a pickup truck doing well over 100mph in the IPASS lane and the driver never received a ticket (she wanted to prove a point about the speeding). They are making it easier to find the speeders by changing the speed limit within two miles of the plaza: http://www.illinoistollway.com/portal/page?_pageid=135,62050&_dad=portal&_schema=PORTAL_________________________________________ you can burn the land and boil the sea, but you can't take the sky from me....
