BoostedXT 0 #1 December 30, 2004 Alright here is the deal. I live in an apartment complex in Colorado, where I will not say. Two weeks ago: The back round is that the place is nice to live in except some of the residents are sketchy. I have had to deal with idiots here before, so then I stocked my house with guns and plan on blasting dudes away if they step foot into my place. Things settled down and the bad company moved out, or evicted, and now I am still here. Well the stripper across the hall got a new BF who I met 2 times and was nice too and so on. I really didnt think anything of it or him. Fast forward to today: I ordered about $2000 worth of camera lenses from a company and they were shiped through FedEx and left on my front door. Well I never got them and was super pissed and I made all these phone calls to find out where they were. Well I get a call from the cops one day and they start to accuse me of being involved with my neighbors. I tell them nope, met them 3 times in about 5 months. Well the dude stole my lenses and pawned them, and the cops found my name in the apartment. So I had to fill out all this paper work and report it all stolen. It turns out the guy who I met is top 10 wanted in Colorado, is being chased by everyone, and now has all my personal info from email, phone, and address. Oh yeah he ran a meth lab there too. My lease runs out in April and Ihave to live here till then. I dont think I have too mainly because of the situation that I am now involved in. Anyone lend a hand? My lawyer said I can get out but it will be a headache because odds are the apartment complex will be a pain in the ass.....I am looking for OT wisdom here. I want to move out mainly because I dont feel comfortable with my ***** being here anymore. Can anyone lend some advice things? Been there before? CN: Dude steals my stuff, $2000 worth of camera lenses. I have to report it to the cops due to price of products. Dude who stole is wanted in Colorado, top 10 list, and now has my info like where I live, email, and so on. Nightingale 0 #2 December 30, 2004 I used to lease apartments, and in my experience, it was pretty easy to convince the apartment complex to let you leave if you were a crime victim. Just tell them how scared you are living across the hall from a criminal, and that you feel the need to inform the entire complex. However, California's leasing laws are very different from colorado's, so you're better off seeking advice from people familiar with the situation in Colorado. chuckbrown 0 #4 December 30, 2004 There's an implied covenant in most residential leases called "quiet enjoyment" meaning that the landlord pledges that he won't do anything to disturb your happy home. Its questionable as to what extent that applies to the acts of third parties, although your lawyer will definitely argue that the landlord knew of the quality of some of the residents and should have known they were likely to disturb you. I'd talk to your landlord first (if you haven't done so already) before sending in the lawyers. Or have your lawyer call and try to work something out without going into court. My experience (as a lawyer) is that once you get into court, people can be much more adversarial and less willing to come to a mutually agreeable solution. IF he doesn't, then it's his ass. Everything you've talked about indicates you're handling things EXACTLY as you should be. My first question to a potential client is usually, "Well, what have YOU done to remedy this?" You've clearly put thought into it. I can't tell you anything else. I'd tell you, "try to fix the problem yourself, report to the police, and if those don't work see a lawyer." Exactly what you have done. However, you may want to report the theft to your credit card company, bank, and credit agencies to institute a "Fraud Check" on your accounts. BoostedXT 0 #10 December 30, 2004 Ok here is everything I have done. I have been pulled over leaving the complex and asked about my neighbors and I complied no questions asked. When my package didnt show I filed reports with Wolf Camera, FedEx, and the local police. The next day the door was busted in and the cops came to my place and talked with me. I wrote up a document with dates and info on the happenings and presented to the detective. This is also the second time I have had to deal with shit like this. The first time a dude came up and tried to beat me up, I gavce the keys to my GF at the time told her to get into the car and lock the door and leave if need be while this dude was running at me. I was ready to leave then but I stayed because they did what they could to help. I told Jenny my friend who is the leasor that I have contacted my attorney, but I dont want to involve them. I want to keep this between us and deal with this like civil adults. Its HER choice how far she wishes to go and whether or not the lawyers get involved. I dont want to sound cocky, but I am civil and a nice person, but I know powerful people, and I WILL get out of the lease. This time its above them. lawrocket 3 #11 December 30, 2004 Well, in many states, the apartment complex can be held liable for damages to you for failure to protect you and/or your property once they've been put on notice of probable illegal activities or likely threats. The apartment management should probably be looking into evicting these folks. Also, considering the violation of the covenant of quiet enjoyment, it would possibly constitute a constructive eviction, if such is available under CO law. I'd have a long discussion with the management, and perhaps ask the police what they can do to help (which will likely be nothing, but will let them know you are not involved). Also, you're a golf pro if I recall correctly. Chances are there are plenty of your customers who can offer you some off the cuff advice. My wife is hotter than your wife. The last delivery from FedEx I had (re:Gateway sending replacement parts for PC over $2000) I heard a truck pull up, looked out window of my home and driver was leaving- no knock at my door, by the time I opened my door, truck was gone. What I do not understand is, the paper work that was sent required my signature....in proof of being received for Gateway records. The package was so huge and would have sat at my door if I was not home.....anyone could have grabbed/ never alone inside a hallway at a door in apartment complex... We got a little note in the mailbox saying we had a package in the leasing office. The leasing office which has a sign in/sign out policy said they never received the package and this was the 6th complaint about USPS packages not making it into the office. They have evicted her, but he wanted for some major stuff. The cops have come to my place a couple times in order to ask me questions and have me fill out paper work. The problem is he is on the loose, and I am guessing has an idea that the cops have dealt with me inregards to him. I dont care about my products. Thats second on my list. Right now my actions are to leave because there is a wanted man running from the cops with the ideas that I turned him in.
