Will their (I used the correct 'their') deceit never cease?! Now they're trying to market the sabre2 as a tandem canopy?!? Someone could get hurt,,,

Never said it was a law, just an observation that in every give-away contest I can think of, the small print or legal ramble always says something to the effect of "No purchase neccessary, see in store for details." Pretty much positive I've heard/seen it on US tv channels and in US magazines too, so I don't think it's a Canadian thing. And yeah, I bet it actually is a law - something to do with advertising standards or gambling or the like.

And like I said, I really don't care. I have 4 PD canopies based largely on the company's awesome reputation. Some silly contest is hardly going to change my mind on that...

Laws vary by state.

I just can't image a law that say if you are going to give some thing away you have to say "no purchase necessary".

What about the sales that Payless Shoes does, you buy one, get one free. You don't get the free one till you buy the first one.

I don't really see a problem with this ad. Credit card companies do it all the time. If you use their card in a certain month you have a chance to get all your monthly charges dropped for that month. What's wrong with that? It's just saying you might get the canopy you're already buying for free.

Ding, ding, ding. We have a winner. That is exactly why there is a "no purchase necessary" addendum to contests. Lotteries are illegal unless the state agrees to allow it. Even when I worked for a casino, we had to have "no purchase necessary" for contests that involved the retail customer. PD could do this contest if they were utilizing a "PD membership" or if the state of Florida was allowing them to host this lottery. If I were PD or any other company, I would have an attorney look over all contest rules before I hosted a giveaway. CYA (cover your ass). :)

I was actually assuming that PD's contest wouldn't apply. I really don't know the law, but their contest seems very different from a lottery. Don't have any idea if it makes a difference legally, but it seems like paying $1600 to possibly win $1600 is different from paying $1 to possibly win $1 million. I dunno... I don't see anything wrong with it (and I love my sabre2 so I'd recommend buying one anyway). :)

I'm not an attorney. All I am saying is that I would have an attorney double-check the rules for me because this is a lottery in every respect. I have nothing against PD, either. I jump a Sabre and my next canopy will probaby be a Sabre2. I like PD and would hate to see them get in trouble.

I agree, luckily, I have a solution.

You may enter the contest at any time, without purchase, by calling Performance Designs, stating your name, and asking them if you've won yet.

They will either congratulate you, and help you plan your travel arrangements, or give you their regrets and thank you for playing.

That's no con. It is not a contest. It's not even a lottery. It's an offer. If you are someone who is buying a Sabre2 soon, you may not have to pay. Of course, it's incentive for all the jumpers who are currently asking themselves "Should I get the Sabre2 or the....?"

Come on pal. Lighten up. If this was a "No purchase necessary" "contest", then what would stop your whuffo next door neighbor from entering and winning a new parachute?

... to either cover their car with, or hurt themselves under before sueing PD.

I was really curious about this too when I saw the ad. I always thought companies had to put a no purchase option in the contests to prevent them from being considered gambling.
