freeflygoddess 0 #1 July 26, 2005 Is it just my crappy finance company or anyone else get this? Todd has a Sebring he is almost finished paying for and well if we just hadn't bought a home we would just pay it off ($2500 left). Any ways, when he bought it, it was his first financed car and the finance company sold the lein to another company last year, and we had the hardest time trying to prove to them we had car insurance, they kept saying that we didn't and we would have to use theirs and would add on all this money to our note and blah blah blah. I had to physically hand them our insurance policy, which we had the whole time. Well we bought a house and so we found a better car insurance company (State Farm) so we can have our home and car together at the same company...cheeper that way too. Any ways, I knew we have had problems before so I called the finance company and let them know that we were switching insurance carriers. I told State Farm to send them a certified letter because of all the problems last year. Well yesterday I get in the mail a letter from finance company saying that since we don't have insurance we have to use theirs and blah blah blah...We had 15 days from the date of the letter to get our own insurance and send them the policy and stuff...well the letter was dated July 11, 2005. The finance company didn't even stamp the letter and mail it until July 22, 2005! So I get it yesterday and today I call and they say well we have added the insurance on and your new car payment is $654 instead of $260, and btw we don't even drive this car because it has a blown head and it was cheaper to just pay off than it is to fix it.....This seems to be such a battle and I think they need some serious butt kicking! Elisha 1 #4 July 26, 2005 1) Don't pay them the additional amount 2) Send them a photo copy or fax them your proof of insurance. State Farm (or whoever) should send you the cards that you are supposed to keep in your glove box (actually, a few copies) so you can prove you have insurance. It should have the policy# on it as well. 3) If they still whine after 2), call a supervisor (call Cust Serv and ask to talk to their manager). Explain your rights, threaten to call the BBB and Department of Insurance for your state. You have the right to refinance with another financial institution (i.e. take your biz elsewhere) and remind them of this. They'll fall in line. Grav we would but we just bought a house like last month credit wise we don't want to hurt our credit any by having another hit so close, besides now I am sure the pay off is sky high since they added so called insurance to our loan. Can you borrow the money from a friend or family member and make arrangements to make monthly payments to them. I would contact the County and/or States Attorney Office as well as the state Insurance Commission. No I am planning on doing something infact I am trying to find an attorny as we speak because I just called again after State Farm told me the fax was sent and they said that they did not recieve anything and I know someone signed the cert letter on July 6th so they have now recieved notice twice, but they claim they haven't. I really don't want to load up all three of my kids in the car in this heat and drive four hours there and god knows how long back just to later hear them say "No she never came by" which I am sure will happen....ugh... Explain that enclosed is a certificate of insurance and that because you are insured, you will not be paying for their insurance. 2) Send them a copy of your insurance. If there's a memorandum of insurance that lists the effective dates, date bound, etc., send that, too. Do this via certified mail, return receipt requested. Once you get the return receipt in the mail, call them and confirm that they have it. if they do not, give them the name of the person who accepted it, the date and time. Then tell them to get off of your back because there is little else you can do, and they cannot charge you for insurance when you've provided proof of it, and you know they received it. So I call finance company and now our pay off is $5967! Just last month on our credit report our pay off was $2489! Now I am really pissed and am on hold with the BBB! The BBB is one of the most corrupt and inefficient beauracracies there is. If the dealer is a member, they will not do anything much as long as he responds to your initial complaint, even if he lies there isn't much they can do. If he is a paying member, they won't even list derogatory info in his file out of fear he will not renew his membership which would cost them a paying customer. IMO you would be much better off contacting the Dept. of Consumer Affairs if your area has one or the County Attorneys Office. Good luck with whatever you decide to do.
