charmsdroppop 0 #1 December 14, 2005 Anybody familiar with timeshares. I am in so much trouble suddenly.....First to admitt what a sucker I am. I got a call for free airline tickets back in march if I went to a 90min. thing about this with no obligation to buy. My dumbass went and 2 champaign bottols later sighned off on what sounded good. Life time vacation places for under 200 bucks a month. Next day I knew I didn't want any part of this. Next thing I know I get a payment book and all this RCI from the Grand Geneva in wisc. I call them and am told wisc. law requires 5 days to cancel not the 30 days I thought. I ask how can I cancel this after putting $1,300 down that I wanted back. No refund and was told to not make payments and it would get suspended. I feel like a big dumsky already about the $1,300 loss. Now I got collection people contacting me. Do I need a lawyer????? I never did get any airline tickets or a copy of the contract. Stupid stupid idiot me!!!!!!!! What are my legal options.......anybody.... flyinghonu 0 #2 December 14, 2005 You should talk to a lawyer in Wisconsin and see if this 5 days BS is even legal. If it's not, then the contract may be considered null & void but I don't know how you would then go about getting the money back - you need a lawyer. Ooh, if you want to do a little homework of your own. Contact the BBB and get a little more information on this company you signed the contract with. If they have tons of complaints, you might be able to the get the BBB to help you resolve the issue. Edited to Add: WTH is "lawrocket" today?!?! I also emailed the agent lady or whatever she is and she claimed to not have gotten my emails in time. How convenient. I have saved those at least to prove my contact attempts. Thanks for your input. Not only may the 5 day BS be illegal and void the contract but the state (i.e. drunk not location) you were in when you signed it will definitely help that. Sebazz1 2 #10 December 15, 2005 Call them and have them fax you, overnight you, PDF you, anything to you the contract. Your attorney will have to review some state qualification matters as well. Gravitymaster 0 #16 December 15, 2005 Under the laws of most states, you must be given a copy of the contract at the time of purchase. The recission term doesn't start until then. If they gave you 2 bottles of Champaign before you signed a contract, then you have very good grounds for cancelling, although it would really surprise me they would employ this tactic given the scrutiny most Timeshares are under by the States Attorney and Real Estate Commission. Is this a deeded Timeshare, or a Vacation Club? If deeded, I wouldn't waste my time with the BBB as they are largely ineffective and generally side with the business. I would contact the State Real Estate Commisssion and the States Attorney by writing a letter explaining all the details. If all you say is true, you probably aren't the first one to lodge a similar complaint. If all you are experiencing is buyers remorse after the 5 day cancallation period, you are stuck. Best thing to do is contact the Timeshare and see if they are willing to let you buy your way out. BTW, I have had a few Timeshares and I love them. Why are you trying to cancel it? Edited to add. And yes ,it is a vacation club that I really don't have any desire or time for. I don't know.....just don't want this in my life. Gravitymaster 0 #18 December 15, 2005 I'd still contact the Real Estate Commission and the Attorney General. What bothers me is them giving you Champaign before signing a contract. In fact IMO it would have been unethical to have given you any alcohol, even after you signed. I'm also bothered that you did not recieve a copy of the contract at the time you signed. Was anyone with you that could be a witness to the Champaign? Other than that, it's just a simple case of buyers remorse and you have to understand that a business is required by law to allow you to cancel within the legal time limit but at some point they are entitled to call it a valid sale and start the Admin. process. Suppose you had purchased something like a car with cash and felt you got a great deal on it, only to have the dealer call you a week later and tell you they made a mistake and undercharged you and either wanted the car back or wanted more money.
