I've lost my faith in humanity

Earnest money doesn't matter. Most contracts have an "attorney approval period" which gives the buyer time to back out for any reason. It sucks but it happens. Hey, when I was looking for a place, I ended up backing out on the first contract I signed because of inspection issues. My seller was pissed too, but I know I did the right thing.

Attorney review lasts in most states for anywhere from three to five days (longer for new construction), but it can be extended indefinitely by agreement of the parties while they negotiate provisions of the contract. The standard practice for resales in New Jersey is for both attorneys to disapprove the contract, and to then rewrite the contract.

Once that's out of the way, the next items that can get a buyer off the hook are a bad pest inspection, structural inspection or failure to get a mortgage within the mortgage contingency period.

But if none of those apply, there's about a seventy-five percent chance the seller will be able to keep the deposit and an even smaller chance of being able to compel specific performance of the contract.

The law works in mysterious ways.

OK, earnest money matters once you are past the attorney approval and inspection periods. I guess I should have been more specific; it does depend on the contract. :P

And I know someone who got cold feet after making an offer on what would have been their first house. Totally panicked and did not think they could afford it after going through the numbers one more time. Major buyer's remorse. With a little help from a friendly boss, they managed to get their pre-approved financing declined and got out of the contract with their earnest money. This was in Texas, and happened several years ago!

And yes, in your case, maybe the cop was right, but you were probably smart not to buy from a psycho regardless. ;)

Damn Michael, what the fuck! I'm so sorry for this "emotional fuckage" you're going thru. I've been off line for a few days and it's amazing how much happens.
I will always keep a good word for ya no matter what or whenever things work out. Like everyone said, someone else will come along and I agree to frickin' paint over those G-Damn measurments. Thier loss!!!!!!!! They say everything happens for a reason and I have grown to lose faith in that but just maybe in this case.........it's a pisser but you'll be OK.
Catchya later, your friend
