micro 0 #1 January 6, 2006 I'm so fucking mad I could just scream.... no, scratch that... I'm so mad that I've moved in to that strange calm that comes w/ severe anger. And I'm in shock. And I don't fucking care that I"m fucking swearing. To hell w/ my fucking new years resolution. So last night, I started this emotional thread about finally selling my house in Nashville, to this wonderful couple who we bought the house from 10 years ago. Fucker calls me tonight saying that after looking at property taxes, interest rates, etc., they can't afford the house after all. This, after he produces PROOF that they are approved for financing, are emotionally invested in the house, it has their g-damned kids measurements still from when they were grown up for crissakes, and now... this. "We can't afford it after all." Shouldn't you have fucking considered that before making me an offer? And no, don't give me any advice... I've offered to lower the price, I've even offered to give them a few more months to save more for a down payment. it's hopelessly fucked. I just want to break something. But I'm posting from skymonkeyONE's and katiebears, and I'm afraid they'll put that spec-ops shit on and kill me. Fuck. I miss Lee. And JP. And Chris. And... RhondaLea 4 #2 January 6, 2006 No advice. But a bit of experience. I've managed several thousand real estate transactions in my time (in New Jersey, real estate closings are managed by attorneys, i.e., by their real estate paralegals). A better offer is going to come along. Soon. I know that doesn't help with the plans you've already made, but you will get a better offer and everything will go smoothly. Hang in there. rl Edited to add: Depending on where you are in the process, their deposit may be forfeit. Check with an attorney. If you don't know where you're going, you should know where you came from. Gullah Proverb

shall555 0 #14 January 6, 2006 Man, I know what you mean. I once bought a house in a market where folks were cancelling offers *accepted* a week before because they got a better offer. Take a deep breath, put these wankers on your *ignore* list and push through this. It'll all work out. shall

Michele 1 #17 January 6, 2006 Take a breath, step back, and realize that while this indeed does suck, it's better to have had it happen NOW then three days from closing, and they can't get the loan funded. That, my friend, is major suckage. If it was going to fall apart, to have it happen before it was taken off the market, and before you had everything packed and a house lease signed for your new place, is the time that's best. As for them, well...all I know is that what goes around, comes around, and people who don't think things through tend to get themselves in a muddle. Tell your son *I* think he's one cool cat...at 7, to get there, cap their knees, and then come home for oreos is a darned good kid. Hugs to you, and hi to Chuck and Katie! skymama 37 #20 January 6, 2006 That happened to my ex and I one time too. He got transferred from Tuscaloosa to Montgomery at a time when the housing market wasn't that great. We were very happy to get a buyer for our house from a couple that also worked for the same company. Everything went fine until the day that we were actually moving into our new home after closing on it. We got a call from our agent saying that the wife did not disclose some old student loans that she reniged on and that they did not qualify for the house. Just like that, we were stuck paying 2 mortgages for about 4 months. We weren't making very much at the time and with 2 small kids, it about did us in financially! I'm sure someone else will come along though, just like they did for us. She is Da Man, and you better not mess with Da Man, because she will lay some keepdown on you faster than, well, really fast. ~Billvon
tigra 0 #21 January 6, 2006 Earnest money doesn't matter. Most contracts have an "attorney approval period" which gives the buyer time to back out for any reason. It sucks but it happens. Hey, when I was looking for a place, I ended up backing out on the first contract I signed because of inspection issues. My seller was pissed too, but I know I did the right thing. airtwardo 7 #22 January 6, 2006 Quote Earnest money doesn't matter. Quote It does here in Texas...I lost 2500.00 a few years ago for backing out on a 'buy'... We own several houses as rental / investment properties, had made offers on two at the same time, which would have worked out had the timing gone as planned... One seller started freaking out when he found out we were closing on another house a week prior to closing on his...and started putting pressure on to close his first...when it was explained to him what and why we were doing what we were doing...he went nuts! He actually broke into our house at 2am one night when he thought no one was home..I caught him going through my desk, sorting financial papers! Had him arrested, and decided to withdraw from the deal on his house...but LOST the earnest money! And yes...went to court...but lost it AND his attorney fees! The cop that took the break in report told me at the time..."It's Texas, should da just shot him...less paperwork to fill out." freeflir29 0 #24 January 6, 2006 Come on..........as others have said........it's not really that big of a deal. It's MUCH worse if it's later in the deal. You'll find a better buyer before you know it. You tried to do something nice. Bank your Karma points and let it go.
chaoskitty 0 #25 January 6, 2006 That sucks, but its not so bad. It could be worse. Someone else will buy your house. Don't get upset, just roll with it.
