Do you have a will?

Mine was done when my reserve unit I usd to be was getting prepared to go to Iraq. The will states who gets what financial assets and who gets what tangible assets and when. My kids aren't 18 yet so I stipulated in the will that any financial assets would be under my fathers control until they were 25. It also states if the person allocated assets in the will is no longer living at the time of my death who will get the asset. That was because the idea was that I would be in a war zone and couldn't go and change my will at any time. Who knows, in the US someone could die of something like car accident. It also states what type of burial will be done. Mine says full military honors.

I am in the works of a living will, but I am a procrastinator... My ex husband would know what to do with my stuff so I am not to worried since all I have is mostly material things. As far as money , well it would all go to my ex husband because he would then have to take care of the boys, so he pretty much will get everything.

One thing I put in my will the attorney had never heard of before. I stipulated that my children would have to go through a financial plan by a certified financial planner. The executor of my estate is my financial advisor. I would encourage them to use him, but any CFP would do, and my estate would pay for it. My executor had to have proof of them receiving the advice before distributing any inheritance.

I figured that is the last piece of motherly advice I could give them....what to do with a money windfall.

I've had one ever since I started BASE jumping. I also have a medical proxy.

The basic idea is to make it easier for the executor of the will to locate your assets and dispose of them according to your wishes.

Stuff like whether you prefer cremation doesn't belong in there.

I have a will (includes living).

My hunny and my parents know & would honor my wishes, but you never know....I mean, we have been known to all ride in a car together. If God forbid something happened to all of us, someone needs to know to pull my plug, take all my organs, and where to send my shit:P

You put anything you want in them. I mean, mine goes so far as to say exactly what I'd prefer be done with my ashes after cremation, though I left that open to be changed if good reason.

Believe me, nothing is too silly or too trivial. They've seen and heard it all:D

A will is just a way of leaving bills to the ones that you love. If you have a will and you die, then your estate goes into probate. Then court costs and lawyers have to be paid. This is why often times you see estate sales. Property that was to be left to the family ends up being sold in order to pay for the legal fees. The only way around this is to set up a living trust. This guarantees that the ones you love get what you intended. The estate never goes into probate, and therefore no legal fees.
