lawrocket 3 #6 March 15, 2006 at least in cali, here's a simple timetable: 1) 3 day notice to perform or quit (i.e., pay your back rent/fix the problem you've created, etc.); or 1) 30/60 day notice of termination of tenancy; 2) Unlawful Detainer action filed (5 days to answer); 3) UD hearing/trial/etc (usually 2-4 weeks after filing answer); 4) Writ of execution issued (within days or hours of the final hearing); 5) Notice to tenant of the date the sheriff's gonna kick you out and restore the premises (at least 48-72 hours prior to the time and date, and up to two weeks after writ issued); 6) Sheriff kicks you out. Brian425 0 #8 March 15, 2006 I have had to evict a person. They had FAR more than 45 minutes. In NYC, it will take 9-12 months in to get to Landlord/Tenant court. Then the trial. During this time, the landlord will present several offers on working out payment. (Must show good faith to the court) Then work with the court to evict the person. So it usually ends up with the landlord not getting paid for 9 - 12 months and trying to collect from a person who has no job or assets. I do feel a little sad for the people; but, I would do it again in a heartbeat. The only time you should look down on someone is when you are offering them your hand. As I indicated before, typically DAYS! They give you notice of when you better be moved out. It says, to paraphrase, "Sheriffs will be here to kick you out at 6:00 a.m. on March 20, 2006. You should be gone by then." Usually this notice is posted on your door by the Sheriff. So, when the Sheriff shows up and you aren't gone, well, they're gonna make it snappy - as in, "Get out now. At least back home. like lawrocket said. cept it starts with certified letters (that can take 3-4 weeks) I dont miss having rental property. What a royal pain in the ass. The only way you can make any $$ at it is property appreciation. Then if you have a couple of bad tenants over a few years, that could eat up all of your profit. When i was a landlord, i always had in the back of my mind that if I had to evict anyone it would take about 2 months.
