giving credit where credit is due

Surfing through the forums this morning, I found a link to this poster, which is distributed by the Australian Parachute Federation. When I opened it up, I was very surprised to see that it contains an edited version of an article I wrote ten years ago (that article has been posted here for a few years now).

I'm glad that people feel the information in the article is valuable, but I'm a bit upset that it was used by the APF without giving me credit for my work. I've just emailed them to request that they put a byline on it, and of course I'm sure they will now that it's been pointed out.

Am I overreacting?

Nope.

Not only that but if they are selling posters with that article on them, you are entitled to be compensated.

Faster horses, younger women, older whiskey, more money.

Why do they call it "Tourist Season" if we can't shoot them?

plagiarism is plagiarism. it's been an issue even here many times. I'd be upset as well. you're not overreacting, you're not being snobby or snooty. It's your stuff, plain and simple.

Here, here. Some folks have been caught, some have not.

Plagiarism is a crime. Pure and simple. Stealing someone else's thoughts and words is done when no permission is given...and that's what they did to you. It's a copyright violation. Some say once it's on the 'net, it's in the public domain. Not so...not so at all. If you wrote it, and it is "published" (and yes, 'net articles are considered published), and then used without permission or approval, it is a violation of the copyright stuff.

I have had several folks from other sites contact me for reprint rights. I've given them gladly. Would I have hit the roof if I found some of my stuff out there without my prior approval and/or accreditation? You betcha.

Lis, it's your work product. It's your call to handle as you want to...but you have every right to be as angry as you are. I'd do what I could to get either/and the credit, the cash, or refuse the right for them to publish.

That's absolutely correct. The ethics of plagiarism aside, once you publish something in the public domain, it's automatically copyrighted - you don't have to register a copyright for the copyright to exist. Those profits (from the sale of posters) are derived from your intellectual property, so you're entitled to them.

You can handle this several ways:
1. The English way: be miffed, but keep a stiff upper lip
2. The German way: be outraged, and invade them.
3. The French way: be indignant, but then surrender.
or...
4. The American way: SUE THE BASTARDS!

I checked out their website. They've got several articles written by others that are properly credited... I'm hoping this was an oversight and not deliberate.

Even if they are selling the poster, it's not about money. I didn't write it for profit in the first place (although I did get $35 from Skydiving mag for it way back in the day :D). I'm not even upset that they used it without permission.

All I want is credit.

My hunch is that someone gave it to them and it didn't have a by-line.
My hope is they give you the credit due.
Their hope is that I don't smack 'em for not. ;)

Not at all... But knowing the APF they will correct it soon. :)
I once posted pictures of a simple $1 device I made for myself on here. A few other people thought it was cool and used it themselves. I found out about 3 months later a manufactor took the idea and started selling it themselves for over $15 and had never talked to me. When asked their reply was "We came up with the idea at the same time you did". Should I be mad?

Probably not, unless you wanna be mad at yourself for not putting in a patent application before posting it. If you had, then it would have been a patent violation. But unless you submit the application, then once it's out there, it's in the public domain, and can be used - and even exclusively patented - by anyone else.

Credit where credit is due -

Kim at APF emailed me back last night (my time; must have been first thing Monday morning Aussie time) with an apology and again this morning to let me know that credit has been given and the revised version will be up on their website soon.

I feel much better now.
