Duckwater 0 #1 June 17, 2006 I made an offer on a DR Horton house in TX. To make a long story short, they forged initals on an offer I never made and cashed my earnest money check. They have refused to return my calls. The a-hole that was selling me the house got pissed because I complained to his boss that he never called me back and initally refused to return my $, 2 days after I cancelled and 20 complaing calls later, he called and said that I would get my $ back. I said OK....We are done. Two days later, the asshole calls me a total of 18 times, leaving the same message that he was returning my call. He even called my work, over and over, harassing the guy that kept telling him I didnt work that week. All the phone calls are recorded as well as my vonage messages. I sent them all to his boss. Their website is: www.drhorton.com I created: www.drwhoreton.com This dumbass harassed me illegally and recorded himself doing it. I want to go take pictures of him and put the calls on the website. ntrprnr 0 #4 June 17, 2006 If you're serious about creating the website to get your message out there and possibly get media, then do the following: Document what happened, similar to how you've done above. Clean it up, use Word and save it as a html doc if that's all you've got, better if you know how. Don't object opinion into it, stick to face. Write up a three paragraph "report" on what happened, and fax it to local media. Be prepared to answer more questions if they call back. It's possible to get media out of this and get it to work in your favor, but you want the odds to be working for you as much as possible. Why don't you file a claim in court for your $1000, plus court costs and lawyer fees? if they really forged something, you may have a claim. If you haven't yet, then if they really did forge your initials, then not only can you get your money back, you can also include a claim for punitive damages. I generally dissuade people from thinking they can get punitive damages, but if you really can prove forgery, this might be the exception. Also, you can file a complaint with your state's attorney general's office - most state AG's offices have consumer fraud departments that handle this sort of thing. As to what you're planning, sure, it's legal, but you'd better stick very carefully to the facts. If they sue you for defamation, chances are your homeowner's insurance will not cover the legal expenses you'll incur to defend yourself, which could be very substantial. Then you say there were forged initials on an offer you never made. So which is it? Did they forge an offer AND one of your checks, or did you back out of an offer which you made in good faith? If its the latter, read though the contract you signed and verify you were within your rights to cancel it when you did, and that they are not entitled to keep the earnest money. Or just hand it over to you attorney and have him deal with it. Forgery and harrassment are both illegal, so you should have recourse. If a crime was committed, report it. I then said I might buy some options and he called me and said "everything is OK". I then go to the mortage guy and find out he had written $5000 worth of options in, forged my imitals on the change, and cashed my check based on that offer. We NEVER discussed any dollar amount worth of options and I never agreed to anything. I DID NOT GET MY MONEY BACK They have been saying "its in the mail".
