... to ask a woman to list on the birth certificate that the father is "unknown?"

A friend of mine got knocked up while cheating on her husband, with a man who was cheating on his wife. Though I don't agree with the situation, I still don't see how a guy could do that to his kid. That right there is telling my friend that the guy wants absolutely nothing to do with the kid.

Its sickening how low people will go these days...

Such events are common. I see the results of shit like this all the time. You don't see how a guy could do that to a kid? What, a guy wanting to sweep something under the rug so he doesn't have to fess up and take responsibility?

I am really beginning to think that the term "man up" is a total misstatement.

Let's see if I understand this correctly.

1. Your friend cheated on her husband.
2. Her lover was married to someone else.
3. She got pregnant.
4. Her lover doesn't want to claim the kid.
5. She's surprised that a guy who cheats on his wife with another married woman isn't being a standup guy about it.

Yeah, I have to agree that it's a Jerry Springer thing.

But, correct me if I'm wrong here, lawrocket...in teh eyes of the law, since she's married, doesn't the husband automatically inherit financial responsibility anyway, regardless of what's on the certificate or the results of a paternity test?

It's gonna be a bitch for her to explain the red hair to a latino husband.:D:D

Usually the birth certificate is done right away---so w/out a paternity test, the true father is, in fact, "unknown".

Once a man (whether he turns out to be the real father or not) puts his name as father on the birth certificate he can & will be held responsible for that child as his own.

Why would a husband, who just found out his wife cheated on him, want to be financially responsible for the child if the child turns out to be the other man's?

There are a lot of crazy situations out there and bottomline, it takes two to tango. While I'm arguing the other side in this case, most of the time I'm arguing the woman's side b/c it's so easy for a man to just leave the situation[:/]

But every situation is different, every one is different and you can't judge based on just those small facts.

Actually I believe that if it is proven through a paternity test he isnt the father he isnt responsible....can someone verify this?

I cannot comment on this for anywhere but California. In California, Family Code section 7540 states, "Except as provided in Section 7541, the child of a wife cohabiting with her husband, who is not impotent or sterile, is conclusively presumed to be a child of the marriage."

Section 7541 (I'll summarize) states that this presumption can be rebutted by blood tests and conclusions of experts that the husband is not the father. But, this motion must be brought within two years of the date of birth of the child[\b].

This means that if the wife is messing around and the hubby doesn't know it, the kid is presumed to be the husband's, and the husband has two years to challenge it with a blood test.

Re: birth certificates - here in Cali, a birth certificate for an unmarried mother contains a provision for a voluntary declaration of paternity. Both the mother and the father must sign it within 10 days, or the father won't be listed on the birth certificate. If a man signs it, he has 60 days to rescind the signature.

Basically, to get your name on the birth certificate, you voluntarily declare that you are the biological father. It takes the birth certificate out of the hearsay realm.

Two whammy's you find out your wife fucked your buddy and you have to pay for his kid....

Surely there'sa way out of the financial situation if youre the victim of such a low life scheme, right?

About the only way out of it was demonstrated a few months ago by Amber Frey. We all remember that she was getting child support from a guy that wasn't the actual father. (there were issues with the default judgment, since she "sewer served" him) Well, this guy went to court to get visitation, since he wasn't gonna be able to discharge the child support. She absolutely did not want that, so when he was about to get visitation, she got the order vacated and substituted in the real dad.

There are lawsuits out there dealing with fraud, etc., but these usually don't go too far because usually you won't be able to get your money back from the lying mother because she's broke, anyway.
