I got arrested for a DUI, blew a .09 at the scene, and got my blood tested as .08 at the jail, the minimum in CA. I spent the night there. I felt sober and fine to drive at .08, but got pulled over for doing 80 in a 65 on a freeway. I hired a lawyer and it eventually got reduced to a wet and reckless and I got to keep my license, and did 6 drug awareness classes.

CA presumes guilt at .08. Down to .04, a conviction is possible with a failed test. (she was spotted for erratic driving). Below .04, innocence is presumed.

But at her body weight, I can buy that one margarita on an empty stomach would put her at that level. That could lead to a plea bargain.
