Need help with a domain

A while back ago our DZ fell victim to the ASC web-site theft.
Our webmaster at the time simply registered us under the .net version of the name and we now use this. It has been a thorn in our side ever since and our intentions were to reclaim the .com. I waited patiently for a year as the .com came up for expiry (10/10/06) and then backordered it. (big mistake) No sooner did I backorder than it came up with a new expiry this time in year 07.

according to info@whois-help.info-- This domain is currently in EXTENDED REDEMPTION --
So I e mailed Info@enom.com who responded --Thank you for your inquiry about this domain. Unfortunately the domain is not for sale or available for registration. There are no current plans to auction or delete the domain, although this is subject to change at any time without notice.--

Objective trademark rights include a registered trademark or an opinion letter from an attorney which analyses and explains your common law trademark rights in relation to a domain name. Surely there are other options to undo what was done and reclaim the domain name.

There was a period of time where a bunch of skydiving websites started to redirect to ASC's website.
According to Network Solutions at the time we were good until 06/07 but another registrar showed it belonging to someone else.
The ASC site came up for about a month then it would redirect to a parked page. I wasn't handling our site then or I would have taken a more active stance at the time.
Stealing domains isn't or wasn't all that difficult if you use a less than scrupulous registry service. Now we have locked the registrar on the .net domain to prevent this from occuring.
So, the first lesson learned was to make sure you lock registrars!

I guess I need to make clear that this was a while back ago, happened right before the USPA got involved with ASCs marketing practices. This isn't a new issue but rather my feeble attempt to correct it.
I do not know if ASC was directly involved, or if it was an overzealous staff member, or what. I would just like to figure out a way to fix it.
So far,unfortunately, it sounds like legal is the way to go.[:/]
