Subletting my Apartment-need some adivce

Recommended Posts

So... Instead of wasting all my BAH and instead of moving yet again, I'm going to try to sublet out my apartment for a while...

I have someone coming over tonight to see if it would work out for her.. but what kind of papers do I need to have her sign and/or what do I do to make sure that she's not crazy and doesnt try to sell off all my furniture or burn the place down while I'm gone? I dont really think she's going to do that... but..... what if?

I can't emphasise too much how useful a contract is. I think it's possible to pick a standard one up from WH Smith in the UK, so you must be able to get a something similar in the US. The Internet, maybe?

Also, get a deposit - not only for unpaid rent, but for damages. Make sure you have decent household insurance too, just incase she does have a beserk episode! ;)

Dude, you've gotta treat it like you're a landlord, because you ARE a landlord.

I'm renting in a friend's house right now, and he basically found a copy of a standard apartment contract, modified it slightly, and handed to me... I thought it was more than fair, but it defined clearly what responsibilities we each held and what would happen if I was late on payments, broke his crap, ect like any other contract.

Also, if you are truly subletting (you are renting from a landlord, and in turn renting out to someone else) then you'd best clear it with the people above you... some places are cool with it and others aren't.

generally sub-letting means someone else assumes YOUR lease for its duration...

But you say "instead of moving".....so i think
you are considering a room mate...:|
is that correct???

.. if so,,, and if you have a lease.. just see if she can likewise sign a lease,, but not with YOU>>> with the Landlord...

Have you checked with the Landlord??
Is that person Ok with a another person living in the unit???

IF you are gonna go elsewhere,, and Sub Let to another.. i think you still need to be sure it's OK... and then yes. exchange signatures,,, on either a Form lease,, or else a printed version of whatever verbal agreement you have come to...

be specific, and don't hesitate to be complete...
mention, rent amounts,, due dates,, dos and don'ts of tenancy.. pet issues, parking issues... and be more detailed If you are NOT gonna live there yourself.. For SURE take some " before" pictures of walls floors, doors etc...
depending on if you Know the new person or not,,, i say, both need to sign a paper which states the "before" condition of the place...
(in anticipation of whatever the AFTER condition might look like...:|..)

... it would be best if the newbie, is asked to pay the landlord directly,,, relieving You of Having to take THAT persons' money ( which may or may NOt always be there) and then forwarding it on to the landlord...

good luck...p s what is BAH..???

I would guess that BAH = Basic Allowance for Housing its the governments way of covering the "Room" portion of "Room and Board" as required by the constitution for its military (at least that's the way I've always understood it... :)

OK.. so here's the deal, a little clearer i guess..

I'm currently renting an Apartment... from an apartment community.

I am in the military, have been gone more than I've been in this apartment, and I found someone who is looking for a furnished place... so I figured while I'm on my next 'deployment' for a month, she-or someone can stay here, and pay me rent, so that I'm not wasting my Basic Allowance for Housing (BAH) on an apartment that I'm not living in.

So... Kinda like a roommate... except that I wont be here. I'll be experiencing the wonders and joys of Survival school up in washington for a month.

I guess I could go ask my leasing manager what it would take, but this would be a very temporary, short term thing-like a month or two. I dont think I want her on the lease... but maybe I should do just that. I really dont know. hmmpphh.

thanks for the suggestions to everyone so far.. if anyone has anything else to add with this new info, please lemmie know:) thanks
