So very angry... (LONG RANT)

First, thanks to everyone for the great advice and support I have received in this thread and PM's.

To Andy9o8: I have already hired a lawyer, my maternal family helped me afford it, they are so wonderful, just wish they lived here [:/]. However, according to my attorney he cannot be served in Mexico. So I will have to await his return to the US. He emailed me yesterday saying that he wired me some money, I don't have it yet, so we will see.

Chuck: I have a ton of respect for you and consider you a great friend. I will give you a call tonight after 7, I can't use my cell phone during the day...trying to keep my bill down. I know the boys would love to see Dylan again, Kevin really talked about him a lot after new years! Thanks a lot for the offer! It means so much to me, I will be taking you up on it! ;)

I totally do not mean this disrespectufully, but you do know that EMT's only make around 25K/yr? That is a very skinny income to raise kids on, esp when you have to pay for child care to work your shifts. If you're a good EMT and enjoy the profession, you'll likely end up back in school for paramedics.

I only brought it up because you sound like you're frustrated and struggling so much for an end that wont change your situation a great deal. [:/]
Best of luck.. dont be shy to ask friends for free babysitting. If they're good friends, they'll understand and let you get them back in favors and other ways that wont cost you money.

Perhaps your lawyer has concluded that it would be impractical or very difficult to serve him in Mexico, especially if he is transient and has no stable address there. Or, maybe your lawyer has other reasons applicable to your particular case, which are the exception to the general rule. He/she certainly knows the facts of your case far better than I do, so I defer to that.

Having said that, there are international treaties signed by both the US and Mexico providing for service of process upon defendants located in one country for lawsuits filed in the other country. There are also several permissible methods by which service of process upon defendants located in Mexico can be done in lawsuits filed in the US. Here are some specific details from the US State Department's official website:

Both the Federal Rules of Civil Procedure (for lawsuits in federal courts throughout the US) and the Florida Rules of Civil Procedure (for lawsuits in Florida courts) specifically provide for service of process in foreign countries.
