tbss 0 #32 July 29, 2008 I think I know the DZ that you're referring to and I too have worked there. If so, you DID sign a non-compete agreement when you started working there. Now sure, that might sound crappy, but if I recall... they've had former employees move to the competing DZ and call/email all their former students to bad mouth the old DZ and bring them to the new. Have you done that yet? Were you thinking of doing that? Don't lie. Sure it sucks that someone had to threaten to enforce the agreement that YOU SIGNED. To me, what sucks even more is that a man who makes an agreement can't abide by the terms of that agreement and instead decides to whine publicly when it is enforced. Wouldn't it be great if people just had the honor to do what they agreed to do in the first place? Good luck!
JohnMitchell 16 #33 July 29, 2008 Quote If so, I'd think you'd have to have a written contract with the DZO stating you would not provide your services to his competitors for some specific period of time. That does not give me the impression of ill-intent on the part of the OP. QuoteSure it sucks that someone had to threaten to enforce the agreement that YOU SIGNED. You guys aren't holding special patents, let others know so they don't waste their money there....This guy seems insecure in his business to freak out like this,,,if you own any business you should have plans in place , even if just in your head, to replace people quickly to keep the doors open. Thats the number one goal,,keep the doors open.............smile, be nice, enjoy life FB # - 1083

Lucky... 0 #40 July 29, 2008 Quote He fired you and is now attempting to prevent you from gaining employment elsewhere. If there is no written contract I would start by filing a small claims suit against him for whatever the maximum amount allowable in your state. Serve him (better yet, get someone else to serve him since you are not allowed on the property) and then call him and see if he still wants to play. If not tell him that a letter to your new employer retracting the threat will result in you dropping the case. If you did sign a contract with a non-compete, well too bad for you. You can't serve a complaint for a suit of which you are a party to anyway. I see it this way based upon what I read, the suit would be from the poster to the DZO for the tort of interfering with the ability to suecure work, I doubt that is the legal claim under which relief is being sought, but it's something like that

stratostar 5 #43 July 29, 2008 Welcome to the world of skydiving and petty assholes who have to flex what little power they have or think they have. I just got kicked off a dropzone last week because of what I posted and said as a former constituent of my USPA regional director, because he didn't like the fact that I called him out in a public fourm for violating the very rules he was to be up holding. Moral of the story is there are a ton of enormous ego driven pricks in the sport that if they feel crossed by you they will try to bully you around like some school yard punk. Again welcome to skydiving, we're family here! you can't pay for kids schoolin' with love of skydiving! ~ Airtwardo

pairashooter 0 #46 July 30, 2008 It sounds like a pretty greedy person to say that if you don't jump there you can't jump anywhere around there. Perhaps if people quit working for those who force them to sign things like this they would fail in the long run. There are plenty of places to work and jump that do not attempt to enslave people.Chris Scaife
