wait... does that mean if I post a picture on dz.com then the photo becomes the property of dz.com and can be distributed by dz.com?

btw: in case you didn't figure it out I agree it seems a little strange... and also seems like a good way for a news agent to avoid paying for a photograph.

fwiw: the guy in the POTN thread ended up getting paid although he didn't really get paid the true "market" rate... and it took some work on his part... :S

I could be wrong but I would imagine that at facebook they certainly have the right to display it on facebook but I doubt they have the right to distribute it to news media... (for profit or not...) and if that is the case... then I'll be linking more photos and attaching pictures here... and at facebook... less...

I know that the POTN forum has specific rules regarding copyright of images and posting of images. (linking or attaching) and retain only the rights to display images posted and have not got the rights to redistribute the images... which is a very important distinction.

It seems incredibly strange to me.

The TV station emailed me this morning for permission to use it and I told them specifically that permission is not mine to give. I did, however, put them in touch with Karen Lewis, who owns the shot. She emailed back (CC-ed me) saying they could use it if they met certain conditions. That was almost two hours ago, so it's possible they did. Regardless, I just emailed the TV station again and told them that if they did not already have permission, they need to remove it immediately, and if they do have permission, I need the photo credit to reflect it correctly.

And that's the end of my involvement with this. I don't know if Karen gave them permission, BUT I CERTAINLY DID NOT. If I had that would make me about the biggest dickhead I can possibly imagine.

Obviously, many of you can also imagine it. [sarcasm]Thanks a ton for that. [/sarcasm]

More news: ktla (the article cited above) is not the station I put in touch with Karen Lewis. Apparently there are multiple TV stations involved here. I put Karen in touch with kabc. I've never had any contact whatsoever with ktla nor any other station, news outlet, blog, etc.

I'm still trying to find out why the hell it's credited to this site, but their website has nothing listed for a contact number, except a main line, which is useless.

It is entirely possible that they were in contact with Karen separately and she gave them permission, though that doesn't explain why it's credited to DZ. If they're not in contact with Karen, then the photo is being used without permission. It's that simple.
