Scoop: Do you not have means to recover against uninsured drivers over there? It can be done over here.

If you pay extra for "uninsured motorists coverage" on your own insurance policy, then that covers your damages from an uninsured motorist. Here in Houston where illegal aliens are everywhere, it's a must-have option. I've got it, and I'm using it to cover my damages. Although there is still a $250 deductible that I'll have to eat. Uninsured motorist coverage for medical bills is $46 per year, and uninsured motorist coverage for property damage is $44 per year. Basically, you are paying extra yourself, to protect yourself from those that break the law and don't live up to their responsibility to have their own insurance. In a perfect world, that wouldn't be necessary, but with unlicensed, uninsured illegals everywhere, we're far from perfect.

StreetScooby: I have heard actually collecting on a civil judgement is extremely difficult, if not impossible. FYI.

Yes, especially if the person is illegal, and knows how to change addresses often and stay out of sight.

normiss: I certainly hope you used a PO Box!

Nope, didn't bother. Besides, my address is on the official police report, which is a public record available to anyone who wants it. You can even get it online as a pdf file for $7.50. I have no privacy here.

I'm not afraid of retaliation. He didn't seem the type. I was more worried about the paroled drug dealer that destroyed my previous car in December, but he left me alone.

Nevertheless, I'll be keeping the gun a little closer than usual at home, and there's always one in the car with me.

AggieDave: The complaint form is not against the officer. Its a complaint issued with the municipal court against the defendant. Basically its you as a citizen offering up a charge within the court.

That's exactly what I need. I just want to make them aware of the additional violation. And that should, hopefully, follow the other paperwork to court so that the judge is aware of it. Even if they don't create an additional charge, at least they can use that as a reason to sentence more harshly on the existing charges.

Thank you for the compliment, sweety. As I recall, when you attacked me near break-off altitude, all I did was track away like a scared little girl. ;)

Some of us not as a political statement but because even legals break the law sometimes, too. Or, they don't break the law, but they purchase only the minimum required level of insurance. I don't know what it is in Texas, but in Washington, it's stupidly low - only $25,000 per person/$50,000 per incident in bodily injury coverage. That doesn't go far in any kind of serious accident. The guy who hit me a few years ago was insured but only at the legal minimums so most of my care was claimed under my own uninsured/underinsured motorist coverage.

I'm sure you weren't as scared as I was doing that little stunt to you. I thought for sure I was going to get my ass kicked when I landed;)

as a former police officer here is how it goes.

license, insurance, registration ,,what you found is all tyo common

the offender is now driving with a differant name, registration and a new 2 day insurance policy.

the officer is pressured by the court, supervisors and politicans not to rock the boat.

if you really want do do something get the local media on your side and things change in your favor.

just be glad he did not harm you ..in that you are lucky

border fences.illegal aliens, law enforcement all are a joke
and now you see just how bad a joke it is.

Question #2: Why didn't the cop give him a ticket for leaving the scene of an accident?

So the cop didn't see the guy run, did he?

The cop shouldn't be able to give tickets for things like the running if he doesn't see it, and the guy doesn't outright admit to it.

I know it sucks, but that rule serves a good purpose. You don't want cops writing tickets on the word of people off of the street.

Update:

The mexican requested a court trial, which was today, 7½ months after he clipped my brand new car, and fled the scene of the accident.

I was subpoenaed to be a witness, and dutifully showed up in court, paying $10 for downtown parking, and taking three hours of my time to commute and sit.

The mexican didn't show up. A warrant was issued for his arrest. I was quickly dismissed as not needed.

So the next time the illegal mexican has an encounter with the law, he won't be walking away from it - they'll take his ass to jail.

His crimes:
1) In the country illegally.
2) Driving without a license.
3) Driving without insurance.
4) Hitting another vehicle.
5) Fleeing the scene of the accident.
6) Failing to pay for the damages.
7) Failure to appear in court.

I think the idea of him spending jail time in the future is a more satisfying outcome than some token monetary fine.
