rwieder 0 #6 June 7, 2009 The Recovery Agent was wrong in this particular incident in that he persisted to recover the plane AFTER the recovery had become "Unpeaceful" A recovery agent must conduct a peaceful recovery, a recovery agent cannot move one vehichle to recover another, drIve on your lawn, and they certainly are not allowed to B&E. You may not shoot a recovery agent unless he/she/they are causing the repo to become unpeaceful or has placed your life, or someone else's life in imminent danger, violated any other regulation of a reposession. They recover by intimitadation, and the ignorance of the general publice's knowledge of reppossion laws. I've responded to at least 10 repo's cases gone bad in the last monh,they're worse than DM call, always a catfight profanity and violance. We've caught more than a few up here recovering without a license and carrying a weapon(s) without a license, and pepper spray, alchol. We haul them off to our brand new Justice Center w/ 200 beds, impound their wreckers fine the shit out of em and cut them loose, wegenrally don't see them again because they know w we'll bust that ass, if their papers are't in order and they have't broken anay laws (Whch i99% of time time hhey do) Know your rights, look them up, Google... Repossession laws in XXXX state and you'll know. If the recovery agents were smart they'd just obtain a search warrant, secure the premises and recover the client's property.
