I am not an attorney but my son is. A judge has substantial authority in ALL matters brought before him. If he ( the judge ) decides that this 'contract' is too one-sided he can merely throw it out. He can say something as simple as, "I will not allow that document to be part of these proceedings." End of discussion. Of course, one could always appeal & hope for the best. It is right there in the decree, in black & white for the world to read. 10 yrs later I took her back into to court to get it reduced or eliminated. The judge said "Mrs. Baumchen, permament does not mean forever." He eliminated it completely. Oh, was she ever mad. And I was dumb-founded; happy, but dumb-founded. Look when I crashed on my bike, I stood back and thought about what happened and was able to stand back and take a logical view of how I screwed up. When I broke my leg on AFP-8 same thing. I I now make sure I do things to prevent me from getting hurt again. Looking back at my divorce....I have no idea what the hell went wrong. And I'm not the only dude to say that. So there is no way for me to logicaly examin what went wrong. Think of this document as your reserve. If she screams herslef into some sick line twist and really wants to take you down this is the only way to get rid of her without ending up dead. And in the end, this document is designed to protect only one person. The Dude. And since nuptuals are a contract this is an extension of said contract. And if properly written it will protect the Dudes ass and his assets. Now you can be all nice and zen and think life is good....in that case why not take half your pay and give it to her, take another $15k give it to some guy you don't really trust or like and oh yeah give her the house as well. If you can live like that....you don't need one of these documents.Life through good thoughts, good words, and good deeds is necessary to ensure happiness and to keep chaos at bay. Nah I live near NYC and line in NJ and well it's amazing how many good looking young girls seem to go for the cut! Graudate from university and CHOP! JerryBaumchen I'm not an attorney either but have far too much experience in courts. Your point is exactly why I say I think we are talking about two different types of documents here. A pre-nup, properly written, will protect your assets in case of divorce. A few of these (again, not an expert, but some experience) may have some behavioral clauses. An example would be, spouse commits adultery and their settlement is lowered. A pre-nup that includes things like how often you have sex, who takes the trash out, who pays the bills, etc. is going to be thrown out of court. That doesn't mean such a document can't be useful for discussion and agreement. It is just not a legal contract that I can see a judge enforcing."What if there were no hypothetical questions?" It would be nice if you could at least acknowledge that somewhere... somehow... a female might... in some version of reality... possibly have money of her own; a career of her own; a brain of her own. AND in some situations, a pre-nup would protect her from just being courted for her *cough* assets. and... about that BMW comment - I will agree that there is a place for the pomp and pretentiousness of a high maintenance flash. But there's nothing wrong with having fun on a 4 wheeler in the hills, a lovely ride on a Harley, rolling out in a Deuce and a half (M35) or a sporty (but cheap) Hyundai Tiburon.
