Ah crap i may have to trade mark this...

Two years ago I made a number of t shirts with a skull and cross pins for my friends who carried my broken ass off the DZ.
Since then I've made more, a total of about 50.
And some of you have one!

Which is all nice!
But i've been getting emails from people who wish to use it on various other items ranging from flags to rigs.

I think I should trade mark it. Can any one help?

But only engineers know the difference between patents, copyright and trademark:P

I ain't reading no government documents, but my understanding of copyright is that it's yours by default as soon as you create something original (within certain criteria, anyway). So in theory there's no need to register it. I guess the challenge is in proving that you were the originator if it comes to a battle.

Now, if you want to allow people to use your design, but for recompense, I guess that's a bit more complicated.

If I were you, I'd be asking myself: do I think there's any money to be made from this design? And if not, I'd simply be flattered that other people like it enough to use it, and maybe ask for a credit when they do. If they intend to make money from it, then tell them they may do so if you get your cut.

Which is why filing is important. There is no other reason than to protect yourself in a court against those that would simply rip you off. Filing absolutely proves the art was legally claimed to exist on a certain date.

On the other hand, if a person doesn't care about people ripping them off, then there's no need to ever file.

Clearly the original poster is concerned. He has only one absolutely proven way of dealing with it legally.

Take some time to read up and understand the very basic differences between Trademarks and Copyrights. They are related, but still separate items protecting separate things.

You may wish to do both if you continue to use the image as your logo for your art services, but you almost definitely want to Copyright the artwork as soon as possible to protect yourself from being ripped off.

Poor man's copyright:

Mail yourself a copy of what you are trying to copyright.

Don't open it until you have to prove it in a court of law. the post mark serves as a date.

I used to do that while I was waiting for my material to go through the "approval" process of the copyright.

Im pretty certain you are not the 1xst person to ccome up with the idea of a skull and crossed pins.
Seeing as how i have seen variations of them in photo's older than the number of days you've had on earth.
You are not now, nor will you ever be, good enough to not die in this sport (Sparky)
