Fucking dumb asses. That's a good way to tank a business. And I mean the hotel charging a bad review fee like that. It's going to blow up in their faces. :|

I occasionally visit Blackpool - this place will not be on my list of hotels to ring and I'll be advising friends not to use them either. As far as I'm concerned this amounts to credit card fraud.



It was in the terms of service that they signed. It really isn't fraud.
They should have read it before they signed it.

It also doesn't fall under "freedom of speech" because it isn't the government, it's a private business.

It is however, one of the most appalling, idiotic and, as Billy noted, "dumbassed" policies out there.

And these guys aren't the only ones to do it either, NPR had a story on it a couple months ago. Same practice, hide an agreement to pay a penalty for a negative on line review in the TOS that everyone signs.

Maybe it is time for disgruntled Americans to contact their congressmen to get a law passed banning that practice.

All businesses should strive to put out their best product or service, and fix any problems or issues, or go out of business, quite simply.

It really should be illegal to fine people for bad reviews if they were truly wronged and those issues were not resolved before the reviews were posted.

Any of you bastards have this policy, FUCK YOU. No business from me!

ETA: Oh and by the way, can you imagine those bastards at Skyride doing this? With all the complaints on them, no telling how much more they'd attempt to rake in. >:(

It's a private contract between a business and a customer. Legally, you can put just about anything you want in that sort of agreement (there are some restrictions, but not for stuff like this).

Rule #1 - If you sign it, read it. South Park had a good one on agreeing to the TOS without reading it.

And if you do find something like this in the TOS, then write an anonymous review. Or have a friend write it for you.

In the case of your posted example I doubt "Your acceptance of this sales contract prohibits you from taking any action that negatively impacts KlearGear.com" would pass muster in court but, as with most things, by the time you're in court you've already lost.

The idea of including an NDA regarding the service you receive in the contract to receive the service is hilarious though. I second the anonymous review suggestion.
